Well, no one likes writing these but, I feel that every course has been tried and the situation still will not resolve itself.

When I was asked to look into this I was surprised and appalled by the conduct of both parties involved. There was a complaint filed about the conduct of Amanda Noon as Commander, Fleet 1 by one of the COs in Fleet 1, TJ Morgan. This complaint involved accusations of conduct unbecoming.

Having been in the middle of arguments over the last three months between Amanda Noon and TJ Morgan I had an understanding of what was going on and the bigger picture. After reading further into the situation and taking everything into consideration I have found that the conduct of both Amanda Noon and TJ Morgan to be disturbing. What started as a conflict in personalities quickly escalated into something more.

TJ Morgan had to take an LOA due to RL issues about the same time the GM of the SS Bonaventure left the ship. Josh Ezell (the XO) requested some help from the Fleet Commander, Amanda Noon. Amanda acted to help the ship and placed herself as an emergency GM. Her style and the style of the command staff on the SS Bonaventure conflicted. Unfortunately this led to further fighting between the command crew of the SS Bonaventure and the Fleet Commander.

When TJ Morgan returned he attempted to regain full control of his ship. Amanda Noon acting as GM refused to step down from the position of GM using her power of Fleet Commander to keep herself there. TJ Morgan brought this fight from Email and IRC to the ship with what can only to explained as insubordination. (http://www.star-fleet.com/webb/node/368522)

This escalated the the fighting to another level and the GMDept was brought it to help the situation. Acting as GMDir at the time I asked Amanda Noon to step down as GM or, I would be forced to remove her as her GM of the ship, has it had resulted in the loss of personnel including the XO.

Amanda Noon then stepped down as GM but continued to talk to members of the crew about side sims on the SS Bonaventure. The crew members that Amanda Noon talked to thought she was talking to them as capacity of Fleet Commander. Once elected president my Vice President Krys McLean (Also Assistant Fleet Commander 1) talked to Amanda Noon about these complaints asking her to leave the SS Bonaventure alone. Amanda continued to contact members of the SS Bonaventure regarding the situation.

Having said all of that I have to take everything into consideration in this. It is my opinion that both parties share blame in not only this situation getting so out of hand but, a total lack of self control and restraint. This was a situation that should have been resolved months ago with a little pride swallowing and restraint.

As it stands this did not happen. So it is my unfortunate duty to figure out what to do about this.

Amanda Noon, you have shown a total loss of leadership skills and self restraint. At many points in this should have stepped back and let others that were not emotionally invested in the situation to step in and take control. This is a benefit of having an Assistant Fleet Commander. I had even asked on many occasions if you wanted me to step in and help and each time I was met with resistance. Part of a leadership role is swallowing your pride and accepting when you need help.

But, I am not blind to the decade of hard work and flawless dedication you have shown to this club. It is my opinion that this is an isolated incident. Because of this it was very hard for me to decide what to do in this situation.

Amanda Noon, because of a lack of leadership ability in this situation, you are banned from serving in a cabinet position for the remainder of the Wonderly term. My advice would be to look at yourself and the conduct of this situation and figure out how this can be avoided in the future. Furthermore because of the already unstable situation that has been caused on the SS Bonaventure I am formally requesting that you refrain from talking to the crew of the SS Bonaventure about any situation that you disagree with on that ship. This will save from any further misunderstandings coming from this.

TJ Morgan, during this entire situation you have made every attempt to circumvent the authority of the Fleet Commander. The biggest thing I am appalled about was bringing in insubordination into your own ship. (http://www.star-fleet.com/webb/node/368522) This is completely unacceptable. Disagreeing with a Fleet Commander at the Email level is one thing. But, even at that level there are paths to take and direct insubordination is not one of them.

TJ Morgan, because of this you are hereby demoted for 60 days to the rank of Commander. At which point, your conduct will be reviewed to see if you are still fit for starship command. If so, you will be promoted back to the rank of Captain, otherwise you will be removed from Command. Furthermore, you are officially warned that any more instances of insubordination will not be tolerated. If these offenses continue you will be facing more consequences from those actions.

Let this be a lesson for everyone. Let's keep our heads in this. There is no shame in asking for help no matter how long you have been around. After 13 years on STF I was asking plenty of people for help and advice when dealing with this situation. There is no harm in it and there is nothing wrong with not being able to do it alone. No one is alone in any of this. First and foremost we are a family. We don't always get along but at the end of the day we are all here for the same reason. We love Star Trek and we love this club.

Today marks a day that will be remembered by space geeks like myself.

Today the Shuttle Orbiter Endeavour (OV-105) launches to run her final mission. This is a historical moment for everyone.

The Shuttle Endeavour was the latest to be added to the fleet, in order to replace the Challenger (OV-099) after it's destruction in 1986.

It's first mission was on May 7, 1992. This was the first three man EVA and the longest US EVA since Apollo 17.

Today marks it's 25th and final mission.

The orbiter is named after the British HMS Endeavour, the ship which took Captain James Cook on his first voyage of discovery (1768?1771). This is why the name is spelled in the British English manner, rather than the American English("Endeavor"). This has caused confusion, most notably when NASA themselves misspelled a sign on the launch pad in 2007. The name also honored Endeavour, the Command Module of Apollo 15.

Endeavour was delivered by Rockwell International Space Transportation Systems Division in May 1991 and first launched a year later, in May 1992, On its first mission, it captured and redeployed the stranded INTELSAT VI communications satellite. This was the first three man EVA and the longest US EVA since Apollo 17. The first African-American woman astronaut, Mae Jemison, was brought into space on the mission STS-47 on September 12, 1992.
In 1993, it made the first service mission to the Hubble Space Telescope. In December 1998, it delivered the Unity Module to the International Space Station.

Under the recommendation of the Academy Commandant and the CO, the USS Apollo is hereby recommissioned as the USS Endeavour NCC-76801-D.

Let the memory of an era and a dream live on through this ship.

A large thank you to the crew for allowing this to take place on the launch day of the Shuttle Endeavour's 25th and final mission.

60 days ago I temporally demoted TJ Morgan to Commander based on his actions as Captain of the SS Bonaventure pending a 60 day review.

At the end of the 60 days I have looked back on TJ actions as CO of the SS Bonaventure. TJ has continued to serve the position of Commanding Officer brilliantly and with a dedication that other should emulate.

That being said there is the question of conduct of a Captain outside the realm of CO. TJ has flirted the line recently and has caused me to pause for a moment in deciding whether to reinstate him. However, this edict will serve two fold on the matter of conduct becoming a Captain.

First, I wanted to layout what I expect from Captains. It's very simple. Follow the rules and guidelines set out and when posting please do not do it in anger. If you are upset or angry when posting walk away for 30 minutes and cool down. If you agree with what you wrote then fine.

Secondly, This is your final warning TJ. This has turned into something I don't like and that is warning you about your conduct. This 60 day demotion was it, TJ. We talked about this and I believe we are on the same page.

All this being said TJ Morgan is hereby promoted back the rank of Captain and is retained as CO of the SS Bonaventure.

TJ, please don't make me write another edict like these two again.

There is a difference in my mind of using peoples words against them in a political argument that can become inflammatory and an all out attack.

Section I of the TOS explains conduct.

"Any conduct by you that in our sole discretion restricts or inhibits any other party from using or enjoying STF will not be permitted. You agree to use STF only for lawful purposes. You are prohibited from posting on or transmitting through STF any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, fraudulent, racially, ethnically, or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or international law. You are also prohibited from posting or transmitting through STF any advertisements of other role-playing game services without the express permission of the Club President or Vice-President. These terms also apply to all STF controlled resources, including but not limited to our official STF chat channel."

Now, the conduct of William of late was filled with a few violations of this bit. I have warned people to calm down in command and yet, those warnings go unheeded.

Abusive, harassing, defamatory, hateful and fraudulent are just a few ways to explain the post made by William Kappler in direct attack toward Andew Robinson. Because of this and because the post serve no reason other then a direct attack of Andrew Robinson, I am trying to weigh my options here.

Now, while I will admit that there has been some pot shots taken on all sides there is a point where lines are crossed. This is that point. William, while some can say that you and Andy both took pot shots at each other, the baseless accusations that you have tossed out just reach too far.

William Kappler is guilty of conduct unbecoming of an officer and violation of the Terms Of Service. William is banned from STF for a period of six months, after which time he will only be readmitted to the club upon issue of a general apology to the president and vice president that will be made public at that time.

There are times where you made a decision and then realize after a time that parts of it was not correct or fair. When I first started as president I was face with a sour situation with TJ Morgan and Amanda Noon. Due to that both parties were punished. Since then, TJ has had his punishment lifted.

Part of what I realized is that while both parties were at fault, lifting one punishment and not the other was not fair or equal. Thankfully, I'm still president and I can fix mistakes that I have made.

So, due to this I have decided to lift the ban on Amanda Noon. She is free to apply and if accepted, to serve within the Wonderly administration cabinet.

I have always wanted to be fair and equal, I believe this course falls within that line.

When Nick became CO of the USS Ark Angel it was known that the ships class needed to change form Nimitz class. So, after talking with both Nick and Cale this has been decided.

The Nimitz class USS Ark Angel NCC-2014-C is hereby re-christened as Mjolnir class USS Ark Angel, NCC-2014-D.

The changes will be made as soon as possible both IC and OOC.

Well where does one start with this?

The other night, TJ Morgan violated the TOS and committed copyright infringement with information from www.star-fleet.com. This was done by placing our copyrighted information on a third party ?free use? site. During a conversation I had with Mr. Morgan, I told him that I needed to review and approve any and all content on a third party site before it was brought into the light. He pasted me a link to the site and before hearing anything back he posted it to the club in command.

So, this leaves us with Mr. Morgan endangering the legality of our organization. This was done after he was told on more then one occasion by more then one person that we do not post content off site. Mr. Morgan has decided that he wanted to ignore the rules in place and do what he wanted to do in this situation.

This is not the first time Mr. Morgan has been in trouble by ignoring the rules and regulations within STF. On 14 April, 2011 I temporally demoted Mr. Morgan to Commander for breaking rules. When he was reinstated to the rank of Captain I told him that this was his last warning.

Normally, I would ban someone for a period of time for a TOS violation and for breaking the rules. However, with Mr. Morgan this has already been done. Hemenway #62 (http://www.star-fleet.com/prez/edicts/hemenway/#e62) talks about this. In here he was (among other things) banned for 30 days for: ?For making unauthorized contact with the potential of creating legal trouble for the club,? And here we are again, talking about the legal implications of Mr. Morgans actions.

Mr. Morgan has been punished and warned about his actions and ignoring the rules. Mr. Morgan has stated that he feels he was doing what was best for the club. I want to be very clear on this point. Violating copyright law, violating the TOS of our site, violating the TOS of a 3rd party site, and ignoring clearly stated rules is not ?In the best interest of STF? and it never will be.

Because of this pattern that has been established and because he has been warned, banned and demoted in the past I feel that there is only one last course of action for this.

TJ Morgan, you are hereby permanently banned from STF. This includes the club and internet chat services.

Okay, stemming from a few conversations, I would like to add the following explanation to Wonderly #23.

Explanation of the TOS violations and Copyright infringement:

When TJ Morgan asked me to use our images in a wiki for a proof of concept, I had no issues with this. Proof of concepts are something that I know well and they are what they say they are. However, in allowing him to do this on a third party site at no time did I authorize the breach of the TOS (Terms of Service) with copyrighted material. There are ways to build and put together a wiki without changing the copyright on the information or material. The TOS for the free wiki site that Mr. Morgan used explained that the information placed there would be ?free use?. This doesn't fall in line with the copyright of the STF material as explained in our own TOS.

I want to make it clear that there are ways to build and use a third party proof of concept wiki without changing the copyright of the material posted there. Now, while this may not sound like a big deal to some I would like to clearly state what this means in ?real world? terms. This effectively means that Mr. Morgan stole intellectual material from STF and gave it away. This would be the same if he had broken into any of our houses and stole something to give away. In the process he violated legal sections of our TOS and violated the legal sections of the third parties TOS.

Now, when I authorized the use on our material in a proof of concept, I also requested that Mr. Morgan allow me to review and authorize it prior to posting it on the STF boards. The reason I requested this was to ensure that everything was legal and it was not mis-representing STF or our material. Had Mr. Morgan followed this request I would have caught this infraction on the spot, yelled at him for not following rules and violating terms of service, demanded he remove the information and would have moved on from there. It would have minimized the exposure and it probably would not have come to this.

There are a couple of lessons in here. Please read the terms of service of websites and anything else. They tell you what is allowed and not allowed in the way of information, what can and cannot be placed on sites like this. When I ask for conditions to something, there is always a reason. Even if you don't understand why I would, there is always a reason. This incident further explains why I request that third party links gets passed through me before posted on the boards and why we don't host our information off-site.

Explanation as to why Mr. Morgan was permanently banned instead of temporally banned:

There are several reasons why I made Mr. Morgans ban a permanent ban.

This is not the first time Mr. Morgan has legally mis-represented STF. During the Hemenway administration there was a situation where Mr. Morgan was temporally banned from STF. This was the first banning from STF.

During the past couple of years Mr. Morgan has shown that he believes that if he doesn't agree with rules then he feels that they don't need to be followed. He has been banned from command, admonished and temporally demoted to Commander for these actions. It has become a pattern that has been getting more and more bold as time as gone on.

When it was brought to light that this information needed to be removed (Both in command and in an email), Mr. Morgan did apologize. However, he also said that it was for the best of the club and he would continue to do what was best for the club. When someone does these things and justifies them as ?okay? and ?for the best of the club? they are more adept to do them again. Mr. Morgan has already said that he feels it was okay and justified and he would do what was best for the club. Based on these statements and a pattern that bas been established and growing for the past several years I felt that to allow Mr. Morgan back into the club would provide another legal risk to the club.

I hope this clears the situation up and if you want more explanations you are free to email me or catch me in IRC to talk about it.

I am sorry this happened. TJ Morgan was a brilliant role player. His ship was a wonderful example of how a ship should be run. However, being a great RPer does not make you above the rules. I have tried to work with him because of his excellent role playing ability. STF has truly lost a talented player and for this, I am sorry. But, in the end, rules are rules and a liability is a liability.

Now, before anyone freaks out about this, I want to make sure everyone understands something. This is something that Sam and I came up with and we are both in 100% agreement. While it may seem like a punishment it really isn't. It is a deal that was hashed out and now needs to be edicted.

When Sam Bibb left the club, he rejoined under a different name in an attempt to remain anonymous. When I asked him about this and asked about creating a second account he said he felt this was the only way he could start fresh in the club. Because we had talked about it, I decided to allow him to continue. I also told him that he would be starting fresh no matter what.

When Sam decided to go back to posting as Sam Bibb we had another conversation and I told him that even though he was not going to remain anonymous, the deal still stood that he had to start over. He agreed to this and requested that I edict this agreement in this manor.

Honestly it had slipped my mind due to RL issues and it sat back on the burner until he asked about it. It then dawned on me that this still needed to be done.

Sam Bibb, as per our agreement you are demoted to the rank of Ensign. Because of the time from when you changed your name and now, there will be no limitations of when you can be promoted again.

Governing Rules About Violations, Investigations, and Tier Sorting (GRAVITieS)

INTRODUCTION
The purpose of this document is to list and define the way that justice is dealt with in Star Fleet. This bylaw will not supersede or overwrite any processes that have already been established in other bylaws.

DEFINITION OF PUNISHMENTS
All punishments will fall under one of the tiers listed below.

TIER 1 ? Permanent Ban
This includes a permanent ban from one or all Star Fleet related resources and must be made via Presidential edict.

TIER 2 ? Temporary Ban
This is any type of ban that is not a Tier 1 punishment, and must be made via Presidential edict. The resource and time frame must be specified in the edict.

TIER 3 ? Rank Demotion, multiple ranks
This is any demotion comprising of more than one member rank loss, and must be made via Presidential edict. All characters above the punished member's new rank must immediately be demoted to the member's highest member rank.

TIER 4 ? Rank Demotion, single rank
This is any demotion comprising of a single member rank loss, and must be made via Presidential edict. All characters above the punished member's new rank must immediately be demoted to the member's highest member rank.

TIER 5 ? Removal from position
This is any removal from the position of Commanding Officer, Department Director, Executive Assistant, or Fleet Commander by the president, for the purposes of punishment. This may be done by edict or by an official post in command, depending on the severity of the punishment.

TIER 6 ? Official Presidential Reprimand
This is an official reprimand from the Office of the President, and may be made publicly in command or privately via email. No edict is issued.

TIER 7 ? Discretionary Presidential Reprimand
Any offense deemed worthy of Presidential action (i.e. greater than Tier 8) but insufficient to warrant a Tier 6 or greater punishment. This is an unofficial reprimand from the Office of the President, may only be made privately via email, and is not entered into any club record.

TIER 8 ? Non Presidential Punishment
This is any punishment given out below the Presidential level by ship Commanding Officers, Fleet Commanders, Department Directors, or Executive Assistants during the normal discharge of their duties. The Office of the President cannot issue Tier 8 punishments.

PUNISHMENT STACKING
Should any one offense be considered especially heinous, resulting in a Tier 5 or above punishment, the offender may receive punishments in multiple Tiers.

COMPLAINTS
If the complaint is member generated, the complaint is sent to the proper authority in the chain of command with all supporting evidence. The alleged offender will be told that there has been a complaint lodged against him, what the complaint is, who the complainant is, and what evidence has been presented to support that complaint. The alleged offender will be given the opportunity to explain his point of view and present any evidence on his behalf, as well as validate any evidence requiring validation as explained below. The deciding authority will make a decision, inform both parties, and provide punishment as necessary.
No complaints may be made anonymously. A complainant can be either an individual, a ship, fleet, department, or the club itself. All complaints must be brought forth within one month of discovery of the alleged offense or violation. All subjects involved in a complaint must cooperate with the investigating authority to the best of their abilities, including but not limited to sending all requested evidence and being truthful at all times.

APPEALS
Appeals to Tier 1 and 2 punishments are subject to the rules laid out by the Executive Government Oversight in the related bylaw.
Tier 3 or 4 demotions from the rank of Fleet Captain or above may be appealed to the Executive Government Oversight. The process for doing so is the same as an appeal for a Tier 1 or 2 punishment. The President's decision is final and is not subject to appeal for all other punishments in Tiers 3-7, except as listed below. Abuse of Presidential Power complaints can be reason to initiate the Impeachment process as described in other bylaws.
Tier 8 complaints can be appealed through the proper chain of command. Should a Tier 8 complaint be brought to the Office of the President, the result shall involve a Tier 7 or higher punishment, a finding of acquittal and subsequent dismissal of the original punishment, or an upholding of the original punishment.

EVIDENCE
The following are considered valid evidence when investigating a complaint:
* IM and PM logs with time and date stamps
* IRC Logs from the Internet Department sanctioned IRC Logger
* Chat room logs
* Emails with full headers detailing club related business
*Posts on Star Fleet
* Any Star Fleet system generated logs

Should a correspondence, either requested or submitted for evidence, contain both club matters and personal matters, the sending party will delete all personal matters not club related prior to submitting the remaining portion as evidence. The other party will be asked to send the same correspondence with any personal matters deleted for verification.
Should one party not have a copy of the requested correspondence to provide to the investigating authority, the redacted copy that has been submitted as evidence will be sent to them for verification.
Should one party dispute the contents of a correspondence copy or log, the investigating authority shall have the final say about what evidence will be accepted for review.

DEFINITION OF OFFENCES
For all Categories, the punishment shall be seen as applicable to offences including, but not limited to, those listed.

Category 1 (a) - Permanent Ban
* Illegal attempts to access, or any attempts to undermine or damage club infrastructure
* Maximum for any violation of Terms of Service

The MAC ship has been very very silent for quite some time. Before I was without a computer I had talked to Mr. Hosick about this and so, this is with his blessings.

To quote edict Robinson #2:

"The MAC 'ship' is required to maintain an ongoing activity level in order to retain its status. Should it fail to maintain an active posting level at any point (active shall be defined here as at least ten valid posts in any fourteen day period) it shall be decommissioned in favour of a static page(s) to be linked to from the Primary Links area."

The MAC ship has not maintained an active posting level. Actually, the last post from the MAC ship was dated on April 20, 2011.

The MAC ship is hereby decommissioned and it's information be moved to static pages.

The Internet Department is directed to make this change within the next seven days.

"The Personnel Director or a named delegate may create other staff positions in the Personnel Department, issued in departmental mandate to fulfill any needs he may deem necessary. The Personnel Director may delegate any duty or authority granted him in this edict or any other to any member of the Personnel Department. The Personnel Department is required to maintain a list of current departmental policies as decreed in departmental mandate in a publicly accessible format. The Personnel Department is required to maintain a list of all current staff members, including those created by departmental mandate in a publicly accessible format.
The Personnel Director may set departmental policy within his range of influence through the issuance of departmental mandates. These shall serve to determine the most efficient manner in which to administer his department and its responsibilities."

Under Mentors Program:

"The Mentors Coordinator shall be responsible for providing a monthly status report for publication by the Personnel Department as a part of their own monthly Departmental update report. This will include, but is not limited to, current mentor numbers, current mentoree numbers, mentoree status at the end of each 30 day period from assignment and any ships which are currently in need of mentors."
The Mentors Program shall be maintained by the Mentors Coordinator, a permanent Personnel Department staff position. The Mentors Coordinator shall be appointed by the Personnel Director or named delegate. The Mentors Coordinator shall be responsible for maintaining the Mentors Program, maintaining an updated list of all current mentors, all current mentorees and shall track the status of mentorees monthly through a three month period from assignment. The Mentors Coordinator shall be responsible for assigning mentors to all mentorees within a 72 hour period from notification of their request by the Personnel Director or named delegate. The Mentors Coordinator shall be responsible for tracking the status of all mentors monthly.

Change to:

The Mentors Program shall be maintained by the Personnel Department and be responsible for maintaining an updated list of all current mentors, all current mentorees and shall track the status of mentorees monthly through a three month period from assignment.
The Personnel Department shall be responsible for assigning mentors to all mentorees within a 72 hour period from receipt of the new members application, the mentor request should be supplied in the email to advise the new members character details and ship assignment. If a mentor request is filed by a current member, a mentor will be assigned within 72 hours of receipt of said request. The Personnel Department shall be responsible for tracking the status of all mentors monthly.
The Personnel Department shall provide a monthly status report for publication as part of the monthly Departmental update report. This will include, but is not limited to, current mentor numbers, current mentoree numbers, mentoree status at the end of each 30 day period from assignment and any ships which are currently in need of mentors.

"The Yearbook shall be maintained by the Yearbook Coordinator, a permanent Personnel Department staff position. The Yearbook Coordinator shall be responsible for maintaining the outward appearance of the Yearbook, updating the yearbook with new submissions, removing inappropriate submissions and ensuring that each standing gallery folder is accurate in placing Gatherings, Current Members and Past Members.
The Yearbook Coordinator shall be responsible for providing a monthly status report for publication by the Personnel Department as a part of their own monthly Departmental update report. This will include, but is not limited to, number of submissions within the previous 30 days and status of any current efforts to increase submissions."

Change to:
