It is my reluctant duty to hereby accept the resignation of Drew Z. Diamond from the Office of the President. Drew thank you for all your service to this club. Good luck and god speed.

As per the rules and regulations laid down in GO I hereby assume the Office of the President effective immediately for the remainder of the term.

Good Evening,
Thank you everyone for being patient as both myself and David Wonderly reviewed all of the facts and conferred with EGO regarding the recent investigation into the actions of Drew Z. Diamond. Furthermore thank you to EGO for taking the time to review all of the data and produce your report regarding these actions.

EGO?s report drew 3 conclusions which I will address individually.

?1) Duplicate Account Use. There is insufficient evidence to prove with any certainty that Drew is in control of either Kay?s or Ciaran?s account. With the evidence available, it is assessed as plausible, but unlikely. Drew?s case would have been further strengthened had Kay responded to requests to discuss her account use over the telephone. (The historical precedence for duplicate accounts has been to verify two independent people are operating the accounts.)?

For the charge of duplicate accounts, Drew, Kay and Ciaran are hereby cleared of all wrong doing. However Drew, Kay and Ciaran are all strongly advised to change passwords so that each individual has a unique password to protect the security of each account.

?2) Interference with an Investigation. While the likelihood of the spoofed email impacting the investigation into plagiarism is very unlikely, Drew did interfere with an investigation with deliberately falsified documents. While there is, strictly speaking, no rule against interfering with an investigation, it is certainly behavior not expected from a President, no matter the reasoning, and would have supported a Notice of Intent to Impeach.?

I have spent a lot of time debating and conferring with EGO and my advisors regarding where interfering with an investigation falls within our rules. Under GRAVITieS ?All subjects involved in a complaint must cooperate with the investigating authority to the best of their abilities, including but not limited to sending all requested evidence and being truthful at all times." After reviewing everything we could not find a specific place where this charge is addressed. However I believe that it is Conduct Unbecoming for a Star-Fleet.com President to be impeding in an official investigation as well deliberately falsifying evidence.

On this charge Drew Z. Diamond is found guilty of Conduct Unbecoming an Officer. Because of his position in the club and the publicity of this infraction Drew Z. Diamond is hereby stripped of all rank and privileges and demoted to the rank of Ensign.

It is my interpretation that K.L. Harvey was pushed by Drew into being an accomplice to falsifying the documentation they submitted in this investigation. Because of this and her spotless record prior to the plagiarism investigation, I am here by issuing an official warning to K.L. Harvey. Additionally I hereby recommend that the GM Director should ban K.L. Harvey for no less than 6 months from participating in any activities on the GMD Ship, including but not limited to submitting new races. Please be aware that future attempts to impede an official investigation will result in stiffer penalties.

?3) Brute Force Attempts. Although entirely unrelated to the original Call for Impeachment, this has been included to ensure all the facts are in the open. It should be noted that while "illegal attempts to access, or any attempts to undermine or damage club infrastructure" (from GRAVITieS, http://www.star-fleet.com/prez/edicts/wonderly/#b2) is a Tier 1 offence, there is no rule (either in the TOS or any of the bylaws) that clearly states users are not to attempt to access the site with anyone else?s username. Again, while no rule has been broken the attempt to gain access to an account, rather than referring it to the Internet Department, would have supported a Notice of Intent to Impeach in this instance.?

This charge has also been a matter of constant debate between myself and my advisors. It is not in my belief that the brute force attempts were done to undermine or damage the club INFRASTRUCTURE, infrastructure being the key word. However it has come to my attention that he knew what he was doing was wrong and against general club policy, yet he still continued to persist in these activities. I have consulted the rules and technically no official rule was broken, however it is generally considered against the law to attempt to hack into another person?s account, especially knowingly hacking into an account through a brute force tactic.

Our Terms of Service specifically lays out that violation of applicable local, national, and international laws is additionally a violation of our Terms of Service, and can result in an immediate termination, or suspension, of access to all or parts of Star-Fleet.com services. (See section ?OUR RIGHTS? sub-section ?ii) Termination?)

Because Drew has previously received a Temporary Ban under our Terms of Service for having duplicate accounts, this will constitute his second violation of the Terms of Service. Under GRAVITieS his second violation of the Terms of Service constitutes a Category 1 Offence.

At the request of her Commanding Officer, Robert Archer, and with permission of FComm-1, David Wonderly, the USS Ark Angel NCC-2014-D is hereby rechristened the USS Ark Angel NCC-2014-E Mythology-Class.

This truely is a testament to the ingenuity of her design that this is the second ship wanting to use the spec. Congratulations to both her designer Robert Archer and the Engineering Department for all of your hard work on this spec.

Thank you to everyone who applied for the Supervisor of Experiments position. I received many good applications, however I feel that there is one person who stood out above the rest.

His vision gave life to the Experimental Fleet so I feel it is only fitting that he is given the chance to make sure it becomes the best that it can. Therefore I'm pleased to announce Joe P as the new Supervisor of Experiments.

I know Steve should be back soon, but in speaking with the FComm-4, we agreed this should not wait as it could adversely effect the ship and hey, if Steve doesn't like it, he can rescind it when he returns. :)

On the advice of FComm-4, who has removed the CO of the Viking due to chronic AWOLing, I hereby appoint Amber Hagan as CO to the USS Viking.
As Amber already holds the rank of Captain, no promotion is necessary at this time.

Recently it has come to my attention that there has been several complaints against Mr. Paul Bartram and his actions in IRC. After reviewing the appropriate logs and talking to several people involved I have come to my decision.

For using a Star-Fleet.com official resource, our IRC channel #Star-Fleet, to initiate unsolicited contact I hereby ban you from all official Star-Fleet IRC resources for a period of no less then 4 months.

Paul consider this your final warning. In the future please be more aware of your discussions with STF members either in public or in private, and keep them appropriate. If further complaints arise regarding unsolicited contact by yourself to any STF member further action may be taken.

This individual has stood out this past term and I believe deserves special recognition.

Many people in this club knows him for his particular style of gm'ing, however he has quickly risen to being one of the best gm's our club has to offer, evidence by his success in the STF awards. Wherever he gm's he is always very well received and creates a successful and interesting simm.

Additionally he has worked tirelessly to revamp the Engineering Department, bringing new life to it and working to bring some of our oldest specs up to our current standards. It is nice to see new life in the Engineering Department.

For his continuing dedication to this club it is my pleasure to promote Robert Archer to the rank of Commodore with all the rights and responsibilities that come with it.

Congratulations Robert, and may the Sisko have mercy on our souls.

Eight months ago at the conclusion of the last election I would have never would have imagined myself stepping into the vice presidency let alone the presidency of this fine group. It has been a tough 8 months filled with ups and many downs.

There are a few people that stood out this term that I would like to personally thank. First and foremost EGO. Larry, Jack, Steven, thank you for your support during the difficult times and helping to bring them to a quick and satisfactory conclusion.

Second to the iDept, Jack and Joe. As many of you know we have had some problems with our server several months ago that required us to change to a new host. Jack and Joe worked hard to secure us a new host and conduct a successful and smooth transfer to our new home. Thank you for keeping our home away from home running smoothly.

I would also like to acknowledge Jack and his Project Genesis team. They have been working hard to bring about the next evolution of the WeBB and I can't wait to see what they come up with.

Finally thank you to all of the members of STF. We have had many rough patches this past term but we have managed to survive. Now is the time to move forward and return this once great club to its former glory. Thomas and Kat I wish you the best of luck as you take the reigns.

The following sections of Joe P Bill #1, Bylaw on X-Fleet’s Establishment and Supervision, are to be modified as noted.

The Restrictions Section will be changed from:
Participation in any aspect of X-Fleet is restricted to members of the club who hold the rank of Ensign or above and possess at least one role playing position within a Fleet as defined by Fleet Command and Mundane Matters (FCOMM). The rank possessed by any character in X-Fleet will not apply to any member rank. Any sims conducted by licensed Gamemasters within X-Fleet will not count towards a Gamemaster’s rank.

To:
Participation in any aspect of X-Fleet is restricted to active members of the club as defined under the Membership Section of Member Order and Organization (MOO). The rank possessed by any character in X-Fleet will not apply to any member rank. Any sims conducted by licensed Gamemasters within X-Fleet will not count towards a Gamemaster’s rank.

The first paragraph of the Decommissioning Section will be changed from:
If an X-Ship ever has less than five players who have posted on it within the previous 30 days, it is to be decommissioned immediately by the SOX. An X-Ship may also be decommissioned by the SOX if that ship’s continued existence somehow violates the Terms of Service. Violations of the TOS by a player who happens to be on an X-Ship will not be grounds for decommissioning.

To:
If an X-Ship ever has less than five members who have posted on it within the previous 14 days it shall be considered on probation. The members of the ship will be notified immediately and be given 7 days to take corrective action. If at the end of the 7 days the ship does not have 5 members who have posted within the last 14 days it is to be decommissioned immediately by the SOX. An X-Ship may also be decommissioned by the SOX if that ship’s continued existence somehow violates the Terms of Service. Violations of the TOS by a members who happens to be on an X-Ship will not be grounds for decommissioning.

Under Exemptions the list will be modified to include:
The Engineering Department will not be tasked with creating, maintaining or codifying specific ship specifications or technologies solely for the use of X-Fleet.

The first paragraph of the Trial Period Section will be changed from:
X-Fleet will be reviewed six months after the date it begins service. The review will take the form of a public discussion held within Command, with the President having the final ruling on whether or not X-Fleet has passed or failed its trial period. The discussion must run for a minimum of two weeks. The review criteria is to include:
